Equity release: strumenti e procedimenti finanziari attraverso i quali il proprietario di un’abitazione può liquidare e incassare una parte dell’investimento effettuato nella acsa.

L’istituto giuridico della “nuda proprietà” diffuso in Italia non esiste nei paesi anglosassoni che hanno invece sviluppato forme diverse di prestito vitalizio (il cosiddetto reverse mortgage, cioè il “mutuo inverso”, o l’home equity loan, cioé il “prestito garantito dal valore della casa”), mentre in Francia sono molto diffusi prestiti vitalizi ipotecari e il contratto del viager.

Inghilterra – Leasehold

La proprietà in Inghilterra è tradizionalmente suddivisa in “leasehold” (simile al diritto di abitazione italiano) e “freehold” (piena proprietà libera da pesi). Un’alternativa e il “share of freehold” dove l’acquirente del “leasehold” acquista anche le quote (proporzionalmente alle dimensioni dell’appartamento) della società che detiene la piena proprietà (molto simile al “condominio” italiano). Tasse: la stamp duty equivale alla nostra imposta di registro e varia dal 3% al 5% per immobili dai 500.000 ai 2.000.000 di sterline, la coucil tax è l’equivalente dell’IMU con la differenza che viene pagata da chi occupa l’appartamento (quindi se il bene è locato rimane a carico dell’inquilino), tasse sul reddito da affitti sono pari al 20% con la possibilità di detrarre tutti i costi sia di manutenzione che di gestione dell’immobile. Gli affitti si dividono in affitti “short term” (alcune settimane) e affitti “long term” (oltre i 6 mesi). Le commissioni richieste dalle agenzie variano dal 10% al 15% annui. La compravendita si effettua formulando un’offerta e attendendo l’accettazione del venditore. Successivamente ciascuna delle parti nomina un “solicitor” (equivalente della figura del notaio italiano) per formalizzare il passaggio di proprietà. I costi variano a seconda del valore della compravendita. Per i finanziamenti ad acquirenti esteri le banche inglesi offrono mutui fino al 40.

Vendita nuda proprietà: As ventas al descubierto de propiedad

La nuda propiedad de una cosa de la que no se tiene el usufructo, recayendo en otra persona distinta al propietario. 
El usufructo es un derecho que da a quien lo ostenta la posibilidad de usar la cosa sobre la que recae (inmueble, mueble, acciones, etc.), con exclusión de otros, y también la de percibir sus frutos o rentas (por ejemplo, si se trata de un piso y se arrienda, quien recibe la renta es el usufructuario). Pero el usufructuario no es propietario del bien, lo es el llamado nudo propietario, el cual puede definirse como el propietario sin usufructo. 
El usufructo tiene como plazo máximo de existencia la vida de la persona sobre la cual se ha constituido (puede constituirse por menos tiempo, pero no por más), de modo que el nudo propietario, que no puede usar la cosa, tiene la expectativa cierta de que cuando el usufructo se extinga, él adquirirá el llamado pleno dominio de la misma y, que aunque el usufructuario vendiera su derecho, éste no duraría nunca más que su vida. 
Ejemplo. El típico supuesto es el de las herencias. Un padre fallece y lega el usufructo universal (es decir, de todos los bienes) a su esposa, y acto seguido nombra herederos (en la nuda propiedad, por tanto), a sus hijos. 
La esposa usufructuaria sabe que durante toda su vida va a poder usar y percibir las rentas de todos los bienes del esposo fallecido, sin que los hijos herederos puedan impedirlo. Incluso, aunque los hijos sean por ejemplo nudo propietarios de la vivienda heredada, la madre podría impedirles su entrada en su condición de única usufructuaria. Y por su parte, los hijos saben que toda la herencia del padre disfrutada por la madre, aunque ahora no puedan utilizarla, cuando ella fallezca será de ellos en pleno dominio puesto que se habrá extinguido con ella el usufructo sobre los bienes heredados, sin que ella pueda impedir este efecto.

Vendita nuda proprietà: Bare ownership sales   … Residuary of right ownership sales

It is the right to use property in which another person (bare ownership) is the owner and to receive income (rents, dividends, …). This right is always temporary, the bare owner who intended to hold the freehold of the property at the termination of the usufruct.
The usufruct is usually life: it lasts the lifetime of the usufructuary and goes to his death. Such is the case, in particular, the usufruct of the surviving spouse.
The usufruct may also be provided for a fixed period (5 years, 10 years, etc..) Under two conditions: 1) If the life tenant dies before the arrival of the scheduled term, the usufruct is extinguished and the bare owner immediately becomes full owner of the property. 2) If a corporation or an association that is usufructuary, the usufruct can not be longer than 30 years.

An investment in bare ownership offers the best outlook in performance. The buyer receives, in the form of an immediate reduction of 50% on the purchase price, the equivalent of all updated rents, net of costs, taxes and charges, that he would have collected over the period had he invested in full ownership. No hidden expenses or risks. At the end of the temporary usufruct, the bare-owner immediately becomes the full owner. The net gain results from the free and automatic recovery of the usufruct, to which is added the re-evaluation of the property over the whole period.

A private investor acquires a quality property for 50% of its value, in bare ownership. At the same time, the usufruct is acquired for a fixed term (15 to 17 years) by an institutional investor who collects the rents and manages rental. Over the whole period, this investor is responsible for all costs, work and taxes. At the end of the usufruct, the original investor automatically and free of charge, recovers full ownership of his property, maintained and renovated.
